摘要: 未成年人既是社会的希望,又是社会良性发展的根据。全面保护未成年人是一个国家从源头上预防和减少犯罪的根本,是社会和谐的基础。因此,必须有特别的刑事司法程序对犯罪的未成年人予以特别的保护。未成年人犯罪程序保护原则的指导思想是坚持对犯罪未成年人的保护、教育和复归。并应当从未成年人最大利益原则,教育为主、惩罚为辅原则,预防为主、减少司法干预原则,双向保护原则,寓教于审、惩教结合原则等方面构建未成年人犯罪程序保护的原则。

Abstract: The underage is not only the hope of society but also the basis for sound development of society.The comprehensive protection of minors,is the foundation for a country to prevent and reduce crime in the source,and the basis of social harmony as well.Therefore,Criminal Justice Proceeding is needed for the special protection of the juveniles who commit crimes.The guiding thought of the procedural protection on juvenile crimes is to uphold the protection,education,and reversion of those juveniles.Meanwhile,we ...
