摘要: 根据 1 969年《维也纳条约法公约》,条约的保留是指“一国于签署、批准、接受、赞同或加入条约时所做的片面声明 ,不论措辞或名称为何 ,其目的是在摒除或更改条约中若干规定对该国适用时之法律效果”。保留具有若干特征 ,而其核心就是排除或更改条约某一规定对保留国适用的法律效果。这也是保留与解释性声明的主要区别。
