摘要: 未成年人前科消灭制度设计应遵循前科消灭制度的一般共性和未成年人特殊权益保护的精神。以此为基点,未成年人前科的概念应从广义的角度进行把握;前科消灭的范围不应做人为的限制;前科消灭的方式应将事前消灭与事后消灭相结合、自动消灭与裁判消灭相结合;未成年人前科消灭应具有绝对的效力。最后,《刑法》第100条应理解为部分前科报告制度,二者之间是彼此配合,不可缺失的关系。
