Abstract: The crime of holding a huge amount of property with unidentified sources is modified in The Seventh Amendment of Criminal Law of China.There are some contradictions between this crime and the principle of presumption of innocence.This article begins with the legislative process of this crime,then analyzes the relations between the crime and principle of presumption of innocence,and advises to modify the name of this crime like as "crime of refusing to explain the resource of huge amount of property",and to establish of property declaration system of national staff and improve the financial regulatory system.
