土地承包经营权抵押问题的法律思考

Law Analysing on the Mortgage of the Right to Contract for Management of Land

摘要: 现阶段,人们对"三农"问题关注的焦点之一,集中在农村土地的利用效率方面。土地承包经营权抵押作为土地承包经营权流转的方式之一,可以吸引更多的资金进入农业生产领域,拓展农民的融资渠道,使农民能够开展规模经营,调整生产结构。为了更好地规范土地承包经营权的抵押行为,要强化集体的监督职能,切实保障其他权利人的优先受让权。

Abstract: How to make good use of the rural land is a big problem in China.This paper analyses the possibility and the feasibility about the mortgage of the right to contract for management of land,analyses the legal problems should be paid attention to during the establishment and executive about the mortgage right which object is the right to contract for management of land.
