论“联名登记权”——夫妻共有财产权的同等保护

On the Right of Joint Registration——Protection of marital right

摘要: 夫妻关系期间所获得的财产既然是法定共同共有制,夫妻作为共有人对共同共有的财产都享有处分权,这在《婚姻法》和《妇女权益保障法》中均有专门规定。但是,在现代市场经济社会,为维护交易安全和第三人的利益,在共有人处理共同共有财产时又常常适用善意取得制度,加之不动产登记制度和《婚姻法》中对共同财产处分权规定的不完善,对共同共有人的财产利益保护往往顾此失彼。文章拟从"联名登记权"这一命题出发,对隐名共有人的合法权利之保护予以法理分析并在立法上提出完善建议。

Abstract: The property acquired during the relationship of husband and wife belongs to both of the parties,and both of them can benefit from it.To protect the couple s joint property,we should make it both from the moral dimension to restrain themselves,and from the law level.
