摘要: 公众参与原则在我国环境法中存在理论基础性地位、基本法立法形式和相应法律制度设置三个方面的缺位,导致公众对环保工作的监督和支持作用不能有效发挥。公众参与原则具有保障环境法基本价值实现的重要功能,必须在我国的环境保护基本法中予以明确确立。

Abstract: The principle of public participant is not regarded as a root position in Environmental law of China.We should put a premium on the public participant in environmental protection and legislate the principle of public participant into fundamental law of China.
