Abstract: The Problem of the witness' refusal to give evidence on the court reflects many problems in Criminal Procedure Law of China.The main reasons are due to the limitations in Criminal Procedure Law of China,mistakes in judicature practice,the lack of witness guarantee mechanisms and the influences of traditional lawsuit notion.The key to solve the problem is to reform our criminal system.
