转型社会公共利益司法保护的制度诉求——民事公诉问题研究

摘要: 我国在转型时期出现了大量的公共利益被蔑视、弱者权益被凌辱的严重问题,社会迫切需要加强对公共利益的保护。民事公诉制度是公共利益司法保护的重要方式,其在中国的复兴,是转型社会公共利益司法保护的制度诉求,既有必要性,也有可行性。我国民事公诉中的公益代表应由检察机关担任,检察机关在诉讼中处于原告的地位。检察机关提起民事公诉的案件范围,以保护公共利益为限。
