论未成年犯缓刑考察制度之完善

On the Improvement of the Probation Investigation System to the Nonage Criminals

摘要: 我国刑法中针对未成年犯的缓刑考察制度存在诸多缺陷,主要是考察主体单一,考察内容抽象,考察方式消极等。这些缺陷的存在使针对未成年犯的缓刑难以产生应有效果,应当针对未成年犯的特点,结合当前正在进行的社区矫正试点工作,完善我国刑法中未成年犯的缓刑考察制度,实质性地增加缓刑考察主体,具体规定未成年犯在缓刑考察期间的义务。
