建立我国刑事被害人国家补偿制度刍议

About construction of national compensation system for the criminal injured party

摘要: 刑事被害人遭受犯罪行为侵害后,如果不能从犯罪人处获得经济赔偿时,国家就应当有义务在经济上帮助被害人,使被害因遭受犯罪而受到损害的身心得以慰藉。随着国际范围内的国家补偿制度建立,从控制犯罪和保障人权的角度看,我国有必要在借鉴国外立法和司法的基础上,结合我国的具体国情,制定出具有中国特色的被害人国家补偿制度。

Abstract: If the criminal injured party can not get compensation from the crininal when injured,the state government will be responsible to telp economically to comfort the injured physically and psychologically Along with the establishment of national compensation system in the world,it is necessary for our country to form the system on the basis of our own condition.
