摘要: 确立行政侵权精神损害赔偿制度,是衡量一个国家民主与法治水平的重要标志。此种制度在发达国家早已形成且正在发展。在我国,这一制度无论从民主与法制的建设需要,还是社会思想文化和经济发展、对外交往的需要均需确立。精神损害赔偿制度是全面有效保护公民合法权利的不可缺少的方式,也是督促依法行政的有力保障,是国家、政府真正代表人民利益的体现。因此,必须认识到它的重要性和必要性,并在此基础上针对我国国情提出一系列有关行政侵权损害赔偿的立法建议。

Abstract: To establish spiritual damage system on administrative tort is important for demoeracy and law in one's county.It's necessary for democracy and construction in legality,no matter what the social cultulral and economic development are.It protectsg people's legal rights and ensures exerting administrative rights according to the law.
