论黑社会性质组织的认定及立法问题

摘要: 黑社会性质组织是介于犯罪集团和黑社会组织之间的、向黑社会组织过渡的一个中间形态 ,是处于初级形式的黑社会组织 ,它与普通的犯罪集团、恶势力及犯罪单位有显著不同。目前 ,我国现行立法中对黑社会性质组织犯罪的规定存在一些不足之处 ,应当加以完善。

Abstract: Criminal syndicate orgenization is a transitional form between criminal gang and criminal syndicate It is obvioutsly different from ordinary criminal gangs,criminal units and vicions groups.At present the law in China concerning it is still in perfect and perfect legal articles are needed to identify criminal syndicate organizations.
