关于完善我国房地产转让立法的几点思考

摘要: 我国现行房地产立法对房地产转让的规定存在弊端 ,转让划拨土地使用权的房地产不应由转让方办理出让手续、赠与不是房地产转让方式而是房地产开发的一种形式 ,转让的房地产在土地使用权期满后国家不应无偿收回。为了规范房地产市场秩序 ,我国应修订房地产立法 ,以进一步完善房地产转让机制。Abstract: There are defects in real estate assignation in our legislation.Formalilies of real estate assignation with land should not be good through by the assigner! Granting is not a form of real estate assignation but a form of real estate.The estate assigned should not be taken back by the state without compensation after expiration of servitude.Real estate legislation of China should be revised to perfect the system of real estate assignation.
