摘要: 新刑法对正当防卫制度作了重大修改。分析新刑法确立的正当防卫制度的内容和特色，具有重要意义。从正当防卫制度的历史发展、性质、立法意图及我国社会治安现状等方面来看，新刑法第二十条第三款规定的是特殊防卫权而不是无限当防卫或无限防卫权

Abstract: The justifiable defence system was considerably amended in the new criminal law adopted in 1997.Proceeding from the legislative background,the author analysed the new system in this article,in particular,the justifiable defence right against violent crimes specified in the new Criminal law.
