Abstract:
Determined by social defense standard and special prevention theory, the educational correction paradigm dominated by personal danger correction and individual treatment has been formed in community correction in China. However, the community correction mechanism with educational correction as the core concept ignores the interest appeal and right protection of the victim (community), the interaction and participation of the public as well as the repair of social relations, which is difficult to apply in practice and has limited effect in the face of multiple correction demands. As a result, the integration of restorative justice, the victim protection, social return, double-sided prevention front theory formed by social recovery as the standard of community correction damage repair theory, the damage repair concept into the correction of criminal personality repair, compensation of repair of the rights and interests of the victim (community), the effectiveness of the repair of social norms and social relations and order the overall repair, omni-directional, multi-level and complex system of damage repair, and on the basis of building damage repair mode of the concrete system type education correction.
