Abstract
With the rapid development of information technology, online teaching has become an important part of modern education. However, this new teaching mode has also brought many challenges in the fair use of copyright. The existing legal framework has the problems of insufficient applicability and flexibility when dealing with the rational use of online teaching. This study holds that, at the legislative level, the existing laws should be revised, the general provisions of fair use judgment should be added, and the scope of application and specific standards of fair use should be clarified; As an important supplement to the application of law, judicial interpretation should play a greater role in the specific judgment of fair use; In the aspect of policy making, the government should issue a copyright use policy specifically for online teaching to encourage the rational use and sharing of educational resources; The perfection of the legal system needs to be combined with technical means to realize the effective protection of copyright and the rational use of educational resources. Future research should focus on the dynamic adjustment of legal system and the innovation of technical means to better support the healthy development of online teaching.
